Competition Terms & Conditions (SME Survey 2020)

  1. Definitions
    1. Competition” means the competition hosted by the Promoters in terms of which the Prize shall be awarded in accordance with the Terms and Conditions;
    2. Entry Period” means 20 August 2020 to midnight on 27 August 2020;
    3. Prize” means a travel voucher to the value of R10,000.00 (ten thousand rand);
    4. Participant” means the owner, director, partner or executive of an SME who enters the Competition;
    5. Promoters” means both SME Africa and Sasfin;
    6. Promoters’ Social Media Platforms” means (i) Sasfin’s Facebook, Twitter, LinkedIn and Instagram accounts; and (ii) the Instagram account of Marnus Broodryk.
    7. Sasfin” means Sasfin Bank Limited, a public company duly registered and incorporated according to the laws of South Africa having registration number 1951/002280/06;
    8. SME” means the small to medium enterprise under the control of the Participant which has a minimum annual turnover of R100,000.00 (one hundred thousand rand) and a maximum annual turnover of R100,000,000.00 (one hundred million rand);
    9. SME Africa” means SME Africa Online Solutions Proprietary Limited, a private company duly registered and incorporated with limited liability according to the laws of South Africa having registration number 2018/513632/07;
    10. Terms and Conditions” mean these terms and conditions which apply to the Competition; and
    11. Winner” means the qualifying Participant selected by the Promoters to win the Prize in accordance with these Terms and Conditions.
  2. The Promoters of this Competition shall award the Prize to a qualifying Participant.
  3. In order to qualify for an entry to win the Prize, a Participant must:
    1. be South African resident; and
    2. complete and submit its answers to the survey hosted by the Promoters within the Entry Period.
  4. A Participant may access the survey by way of email (if the Participant receives the survey by email) or via social media. The survey shall be sent to subscribers of the Promoters’ email newsletters.  A link to the survey shall also be published on the Promoters’ Social Media Platforms. 
  5. There shall be a single Winner of this Competition.
  6. The Winner of the Prize shall be selected from a list of all Participants by way of a random electronic draw.
  7. The Winner shall be publicly announced during a live webinar entitled “SME Research II Results” hosted by the Promoters on 3 September 2020 at 17h00, following which the Winner shall be contacted directly by the Promoters by way of email. Failure to attend the webinar shall not disqualify the Winner from claiming the Prize. If the Winner fails to attend the Webinar, the Promoters will contact the Winner via email.
  8. The Winner must respond to the Promoters’ email within 72 (seventy-two) hours of transmission thereof in order to claim the Prize. Should the Winner fail to claim the Prize within 72 (seventy-two) hours of the Promoters’ email communication, the Promoters shall select a new Winner by way of a random electronic draw.
  9. Only one entry per Participant shall be permitted.
  10. The following persons are disqualified from entry into the Competition:
    1. directors, members, partners, employees or agents of or consultants to the Promoters;
    2. a spouse, life partner or close family member of a director, member, partner, employee or agent of or consultant to the Promoters; and
    3. any person who directly or indirectly controls or is controlled by the Promoter.
  11. All travel arrangements in conjunction with the Prize shall be made by the Winner through the Promoters’ appointed travel agent.
  12. The Promoters will pay for the travel arrangements up to a maximum of R10 000 (ten thousand rand).
  13. The Winner will need to abide by any additional terms and conditions required by the Promoters in relation to the use of the Prize.
  14. The Prize shall be valid from the date of announcement of the Winner until 30 June 2021, following which it shall expire and the Winner will have no claim against the Promoters for the Prize.
  15. Participants acknowledge that this Competition does not carry the endorsement of any social media websites or applications.
  16. The Winner shall, at its election, grant the Promoters the right to publish its name, logo and photographs on its social media platforms and in any advertising or promotional material following the announcement of the Winner.
  17. The Promoters have the right to audit the name and email address which a Participant uses to enter the Competition.
  18. Participants shall not receive payment for their participation in this Competition or the submission of the response to the survey.
  19. The Prize is not transferable or redeemable for cash. The Promoters may substitute the Prize with any other Prize of similar value at their discretion.
  20. The Promoters are not liable for any technical failure that may result in an entry not being successfully submitted.
  21. Participants hereby indemnify the Promoters against any loss, damage, costs, expenses and liabilities which the Promoters may suffer or incur as a result of or in connection with any claim by a third party arising out of the actions or omissions of the Participant.
  22. The Winner of the Competition hereby indemnifies the Promoters against any loss, damage, costs, expenses and liabilities which the Promoters may suffer or incur as a result of or in connection with any claim by a third party arising out of the actions or omissions of the Winner.
  23. The Promoters shall not be liable for any loss, damage, costs, expenses and liabilities that the Winner of the Competition may suffer in connection with this Competition, including, but not limited to, as a result of the Winner’s acceptance of or use of the Prize.
  24. The Winner accepts the Prize at its own risk.
  25. Any expenses over and above R10,000.00 (ten thousand rand) which the Winner incurs during or in connection with the use of the Prize shall be for Winner’s own account.
  26. This Competition shall be governed by South African law.
  27. Participants provide the Promoters with their express consent to process their personal information in accordance with the Protection of Personal Information Act 4 of 2013 for the purposes of this Competition and for marketing of the Promoters’ products and services. Participants provide their express consent to the transfer of their personal information to the other companies within the Promoters’ group of companies for marketing purposes.
  28. The Promoters have the right to terminate this Competition in the event that any element of the Competition is deemed unlawful. In this event, a Participant shall have no claim against the Promoters.
  29. The Competition Terms and Conditions shall be published on http://sasfin.com.

Forex SDA Campaign Terms and Conditions

  1. Definitions:
    1. "Applicant" means either an existing or potential client of Sasfin who is applying, in his/her personal capacity, to conduct a Transaction;
    2. "FICA" means the Financial Intelligence Centre Act 38 of 2001;
    3. "FICA Documentation" means, collectively, (i) a barcoded identity document; (ii) tax registration number; (iii) a proof of address which is dated within 3 (three) months of the date of submission to Sasfin; and (iv) any other documentation that may be required by Sasfin from time to time;
    4. "Sasfin" means Sasfin Bank Limited, a public company duly registered and incorporated according to the laws of South Africa, having registration number 1951/002280/06;
    5. "Single Discretionary Allowance" means the R1 000 000 (one million rand) allowance available to South African residents (natural persons) and foreign nationals who qualify, 18 years and older per calendar year, as provided for in the Currency and Exchanges Manual for Authorised Dealers in Foreign Exchange;
    6. "Terms and Conditions" means these terms and conditions; and
    7. "Transaction" means the Applicant’s transfer of up to R1 000 000.00 (one million rand) under the Single Discretionary Allowance.
  2. The Single Discretionary Allowance is available to South African residents and foreign nationals who qualify who are 18 (eighteen) years and older.
  3. Sasfin is inviting Applicants to apply to Sasfin to conduct a Transaction in accordance with the Single Discretionary Allowance.
  4. Sasfin is offering competitive Transaction fees to successful Applicants in respect of Transactions to be completed on or before 31 December 2020.
  5. Should an Applicant have obtained a quote from another Authorised Foreign Exchange Dealer (other than Sasfin) in respect of the Single Discretionary Allowance, the Applicant may request a more competitive quote from Sasfin.
  6. In order to qualify for the competitive quote, the Applicant must provide Sasfin with a valid quote from the other Authorised Foreign Exchange Dealer in which the Transaction fee is specified, as well as the relevant FICA Documentation.
  7. In addition, the Applicant must complete the online application form provided by Sasfin (available at sasfin.com) and any additional documentation as required by Sasfin. A successful Applicant will also be required to enter into the relevant agreements with Sasfin.
  8. The Applicant will be required to disclose the source of funds to be used in the Transaction and may be required to provide Sasfin with proof thereof.
  9. Each Transaction shall be subject to and conditional upon compliance with any applicable law including, without limitation, FICA and the Exchange Control Regulations.
  10. The Applicant warrants that all information provided by it to Sasfin is true and correct.
  11. These Terms and Conditions shall be governed by the law of South Africa.
